Privacy Policy

This policy explains what personal data Agafay Nights collects when you use agafaynights.com or book our desert activities and camps near Marrakech, why we use it, and the choices you have. We keep it simple because we collect very little.

1. Who we are

Agafay Nights, based in the Agafay Desert, Marrakech, Morocco, is responsible for your data (the “data controller”). You can reach us at go@agafaynights.com or by phone/WhatsApp on +212 707591335.

2. What data we collect

• What you tell us when you enquire or book: name, phone/WhatsApp number, email address, travel dates, number of guests (and ages of children if you tell us), hotel or pick-up point, preferences and the content of your messages.
• How it reaches us: when you press “Send booking request” (or “Send message”), the details you entered are sent securely (HTTPS) to our server, which forwards them by email to our business mailbox so that our team can reply. If you gave an email address, we also send you an automatic confirmation copy. The website does not keep these requests in a database. If you prefer, choose “Continue on WhatsApp” (it opens WhatsApp with a pre-filled message you can edit and send yourself) or write or call us directly.
• Technical data: like any website, the server that hosts this site automatically records standard technical information (IP address, date and time, pages requested, browser type) in its logs. This is handled by our hosting provider for security and reliable operation. Our server also uses your IP address briefly, in memory, to limit spam and abuse.
• A preference saved on your device: if you choose a currency (€, $ or DH) the site remembers it in your browser’s local storage so you don’t have to choose again. It stays on your device and is not used to identify or track you.

3. What we do not do

• We do not use advertising, analytics or tracking cookies on this website at the time of writing. If we add any, we will ask for your consent where required and update this page.
• We do not sell or rent your data.
• We do not take card payments on the website; payment is arranged directly with our team.
• We do not make decisions about you using automated profiling.

4. Why we use your data

• To answer your questions and prepare your quote or booking — necessary to take steps at your request before a contract, and to perform the booking you ask for.
• To organise your activity or stay (transport, camp, guides) and keep in touch about it — performance of the booking.
• To meet legal obligations, such as accounting and tourism-related rules.
• For our legitimate interests, such as keeping the website secure and preventing abuse.

5. Who we share it with

• Camps, drivers and guides who deliver your booking receive only what they need (for example your name, group size, dates and pick-up point).
• WhatsApp (Meta) if you contact us through it. WhatsApp processes messages under its own terms and privacy policy.
• Our hosting and email providers, who process data on our behalf to run the website and mailbox.
• Authorities, only when the law requires it.

This website does not load third-party scripts, fonts or trackers. Links to WhatsApp and other external sites are governed by those sites’ own policies.

6. International transfers

We are based in Morocco, and our providers (such as WhatsApp or hosting) may process data in other countries. Where this applies, we rely on the safeguards offered by the provider and applicable law.

7. How long we keep your data

We keep enquiries and booking details for as long as needed to answer you, carry out your booking and handle any follow-up or claim, and for as long as the law requires us to keep accounting records. After that we delete or anonymise them. You can ask us to delete your messages earlier (see below).

8. Your rights

Under Moroccan Law No. 09-08 on the protection of personal data (supervised by the CNDP) and, for visitors in the EU/EEA, the GDPR, you have the right to access your data, correct it, have it deleted, object to or restrict its use, receive a copy in a portable format, and withdraw consent at any time. To exercise a right, email go@agafaynights.com; we will reply within a reasonable time. You may also complain to the CNDP or to your local data-protection authority.

9. Cookies and local storage

We do not set cookies. The only item we store in your browser is your currency choice (local storage key agafayCurrency). You can clear it at any time from your browser settings.

10. Security

The website is served over HTTPS and we limit access to your information to the people who need it to deliver your booking. No method of transmission or storage is 100% secure, so please avoid sending sensitive information (such as payment card numbers or ID numbers) in messages.

11. Children

Our services are booked by adults. If you tell us the ages of children travelling with you, we use that only to adapt the activity and prices.

12. Changes to this policy

We may update this policy, for example if we add analytics or new services. The date at the top shows the latest version.
